I think you're both wrong, photoshoot pictures are always copyrighted - either by the photographer or the magazine, or both. They'd have to be crazy to not protect them.
The reason why such photos appear on products Ayu doesn't officially endorse is simply becouse they're used without permission in vast majority of cases - I really doubt any of these could be 'quietly' licensed, i.e. used with Ayumi's permission without avex informing the public that some deal's been made. We haven't heard of any nail, socks, hair dyes endorsements from Ayumi/avex, which means they are most probably not legit.
Seeing how this has been going on for quite some time now and avex is taking no action against, I guess people just don't feel threatened using copyrighted works and thus they keep doing it...
