Oh, SME also released a statement in the name of Changmin and Yunho (not included in the lawsuit) with not so nice words for the other three members. The statements were signed, but any fan that has seen their signatures before could see that those signatures on that statement were fake
Really, if you want to fool fans, you have to try harder than that
A few days or a week ago, someonf of SME admitted that those signatures weren't real, but the statement was written after hearing the two members (read: we just turned their words so we could hurt the other three).
SME also announced a concert (3rd Asia Tour 2009 ~Mirotic~) in China, but called it off because "Junsu, Yoochun and Jaejoong don't want to perform". In reality the three didn't know there was a concert scheduled in China, because SME never told them. So, they wanted to hurt the fans. Conclusion: SME is evil
No really, they are just being childish about this. There were also rumours that the members were watched by SM staff in Japan and that they weren't allowed to talk to each other.
