Yes, originally Sam was granted custody. I don't think it had anything to do with her schedule etc but more to do with the fact that there is still a major imbalance of the sexes in Japan and as you said the judge seems like he favored Sam for that reason alone. They apparently all still lived in the same apartment building at this time though so it seems like maybe legally Sam had custody, but in reality Haruto was still with Namie most of the time.

Yeah, it really doesn't show anything bad. Much more in depth reports were aired on Japanese tv.
