The JASRAC-YouTube fracas is the latest example of the continuing clash between users' and copyright holders' rights in the digital era. Music videos are a great promotional medium, as the history of MTV shows, but the music biz has always had a problem figuring out whether videos are strictly for promo purposes or are a product just like CDs. From a strictly legal point of view, JASRAC is well within its rights to demand that YouTube stop posting copyrighted material without authorization, but it can also be argued that such a policy is short-sighted, because it could cut off an effective way of promoting Japanese music to the wider world.
